These Terms of Service ("Terms") govern your use of the Brain Dump mobile application ("Application" or "App") created by Steady Labs ("we," "us," "our," or "Service Provider"). The Application is provided as a commercial service.

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the Application.

1. Acceptance of Terms

By accessing or using Brain Dump, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Steady Labs.

If you are using the Application on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Brain Dump is a productivity and task management application designed to help users capture thoughts, organize tasks, and manage their time more effectively. Key features include:

• Voice and text-based "brain dump" for capturing thoughts
• AI-powered task extraction using Google Gemini
• Task management with focus sessions
• Emotional check-ins and tracking
• Customizable reminders and notifications
• Cross-session data synchronization

The Application uses anonymous authentication, meaning you can use the service without providing personal identifiable information such as email addresses or names. Your data is tied to a device-based identifier.

3. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use Brain Dump. By using the Application, you represent and warrant that you meet this age requirement.

If you are under 18 years old, you must have permission from a parent or legal guardian to use the Application.

4. Account & Device Authentication

Brain Dump uses anonymous authentication based on a unique device identifier. This means:

• Your account is tied to your device, not an email address or username
• If you uninstall the app and reinstall it, you may lose access to your previous account and data unless you've backed it up
• If you switch devices, you will need to manually transfer your data or start fresh
• We cannot recover your account if you lose your device or uninstall the app without backing up your data

It is your responsibility to back up your data if you wish to preserve it.We are not responsible for any data loss resulting from device changes, uninstallation, or device failure.

5. Subscription & Payment Terms

5.1 Trial Period

New users receive a free trial period as specified in the app. During the trial:

• You have access to all premium features
• No payment information is required
• The trial will automatically end on the specified date
• You will not be automatically charged when the trial ends

5.2 Paid Subscriptions

After your trial ends, you can choose to subscribe to continue accessing premium features. Subscription terms:

• Subscriptions are billed through your Apple App Store or Google Play Store account
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscription prices are clearly displayed in the app and may vary by region
• We reserve the right to change subscription prices with advance notice

5.3 Managing Subscriptions

You can manage and cancel your subscriptions through your device's account settings:

• iOS: Settings → [Your Name] → Subscriptions
• Android: Google Play Store → Menu → Subscriptions

Subscriptions are managed by RevenueCat on behalf of Apple and Google. Please review RevenueCat's Terms of Service.

5.4 Refunds

All purchases are processed through the Apple App Store or Google Play Store. Refund requests must be made through the respective platform:

• Apple: Request a refund
• Google: Request a refund

We do not have the ability to process refunds directly. All refund decisions are at the discretion of Apple or Google.

5.5 Free Tier

After your trial or subscription ends, you may continue to use a limited free version of the app with restricted features. We reserve the right to modify the features available in the free tier at any time.

6. AI-Powered Features

Brain Dump uses artificial intelligence (Google Gemini) to process your brain dumps and extract actionable tasks. By using this feature:

• You acknowledge that your brain dump text will be sent to Google's Gemini AI service for processing
• You understand that AI-generated suggestions may not always be accurate or appropriate
• You agree that the AI is a tool to assist you, not to make decisions for you
• You are solely responsible for reviewing, editing, and acting on AI-generated content
• We do not guarantee the accuracy, completeness, or usefulness of AI-generated suggestions

AI usage is subject to rate limits based on your subscription tier. Excessive use may result in temporary limitations on AI features to ensure fair usage for all users.

7. Voice Recording & Transcription

Brain Dump offers voice-based brain dumps using your device's microphone. By using this feature:

• You grant us permission to access your device's microphone
• You acknowledge that voice recordings are sent to Deepgram for speech-to-text transcription
• Voice recordings are not permanently stored; only the transcribed text is retained
• You are responsible for ensuring you have permission to record any voices other than your own
• You must not use voice features to record confidential, private, or illegal content

8. User Conduct & Prohibited Uses

You agree to use Brain Dump only for lawful purposes. You must not:

• Use the Application to store, share, or transmit illegal content
• Attempt to reverse engineer, decompile, or extract the source code of the Application
• Use automated systems (bots, scrapers) to access the Application
• Attempt to bypass rate limits, trial periods, or payment systems
• Use the Application in any way that could damage, disable, or impair our servers or networks
• Attempt to gain unauthorized access to other users' data
• Use the Application to harass, abuse, or harm others
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Violate any applicable local, state, national, or international law

Violation of these terms may result in immediate termination of your access to the Application without refund.

9. Intellectual Property Rights

All intellectual property rights in the Application, including but not limited to trademarks, copyrights, design rights, patents, and trade secrets, are owned by Steady Labs or our licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with these Terms.

Your Content: You retain all rights to the content you create in the Application (tasks, brain dumps, notes, etc.). By using the Application, you grant us a license to use, store, and process your content solely for the purpose of providing the service to you.

10. Third-Party Services

Brain Dump integrates with several third-party services to provide its functionality. These services have their own terms and conditions:

• Supabase Terms of Service (Database & Authentication)
• Google Gemini API Terms (AI Processing)
• Deepgram Terms of Service (Voice Transcription)
• Expo Terms of Service (Push Notifications)
• RevenueCat Terms of Service (Subscription Management)

By using Brain Dump, you agree to comply with the terms of these third-party services. We are not responsible for the actions, content, or privacy practices of third-party services.

11. Internet Connection & Data Charges

Brain Dump requires an active internet connection (Wi-Fi or mobile data) for many features, including:

• Brain dump processing with AI
• Voice transcription
• Task synchronization
• Push notifications

We are not responsible if the Application does not function properly due to lack of internet access. You are responsible for any data charges incurred from your mobile network provider, including roaming charges if you use the Application outside your home territory.

12. Device Security

You are responsible for maintaining the security of your device and access to the Application. We strongly recommend:

• Keeping your device's operating system up to date
• Using a secure lock screen with PIN, password, or biometric authentication
• Not jailbreaking (iOS) or rooting (Android) your device, as this may compromise security and cause the Application to malfunction
• Installing apps only from official app stores (Apple App Store, Google Play Store)

We are not responsible for security breaches or data loss resulting from:

• Jailbroken or rooted devices
• Malware, viruses, or malicious software on your device
• Unauthorized access to your device by third parties
• Loss or theft of your device

13. Updates & Modifications

We may update the Application from time to time to add features, fix bugs, improve performance, or ensure compatibility with new operating system versions.

Your Responsibilities:

• You are responsible for keeping the Application updated
• We may require you to update to continue using certain features
• Older versions may stop functioning as we update our backend systems

Our Rights:

• We reserve the right to modify or discontinue features at any time
• We may change subscription pricing with reasonable advance notice
• We do not guarantee that the Application will always be compatible with your specific device or OS version

14. Disclaimer of Medical Advice

By using this Application, you understand and agree that:

• The Application does not provide medical advice, diagnosis, or treatment
• The Application is not a substitute for professional mental health care
• The Application is not intended to diagnose, treat, cure, or prevent any disease or condition, including ADHD
• You should not rely on the Application for medical decisions
• You should consult with a qualified healthcare professional for any mental health concerns
• In case of emergency or crisis, contact emergency services immediately (911 in the US)

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STEADY LABS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Application
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of the Application
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Application by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Application
• User content or the defamatory, offensive, or illegal conduct of any third party
• Reliance on AI-generated suggestions or content
• Loss of data due to device changes, uninstallation, or other causes

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

16. Indemnification

You agree to indemnify, defend, and hold harmless Steady Labs, its officers, directors, employees, agents, and third-party partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the Application
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you submit to the Application

17. Termination

Your Right to Terminate: You may stop using the Application at any time by uninstalling it from your device. To delete your account and data, contact us at [email protected].

Our Right to Terminate: We reserve the right to suspend or terminate your access to the Application at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons
• Discontinuation of the service

Upon termination, your right to use the Application will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Steady Labs operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Application shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

19. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last Updated" date at the top of this page
• We will notify you through the Application or other reasonable means
• For significant changes, we may require you to accept the new Terms before continuing to use the Application

Your continued use of the Application after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Application.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the other provisions of these Terms, which will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Steady Labs regarding your use of the Application and supersede all prior agreements and understandings.
